These Terms of Use ("Terms") govern your use of the Burn mobile application ("Burn"), burnfasting.com, and related services provided by WraithBit, Inc. ("we", "us", or "our").
By downloading, accessing, purchasing, or using Burn, you agree to these Terms. If you do not agree to them, you should not use Burn.
Burn is a fasting and health tracking application designed to help users track fasting periods, follow their progress, understand fasting stages, establish routines, and access related health and fitness information.
Burn includes both free functionality and optional paid features available through Burn Pro.
Features may change, be added, removed, or updated as the product develops.
Burn is provided for general health, fitness, informational, and educational purposes.
Burn is not a medical service and does not provide medical advice, diagnosis, treatment, or professional healthcare services.
Information presented by Burn, including fasting stages, timers, calculations, estimates, scores, trends, insights, recommendations, and educational content, should not be treated as a substitute for advice from a qualified healthcare professional.
Fasting affects people differently. Factors including age, health, medications, medical conditions, activity, nutrition, sleep, and individual physiology can influence how your body responds.
You should use your own judgement and, where appropriate, consult a qualified healthcare professional before beginning or making significant changes to a fasting, nutrition, exercise, or weight-management routine.
In particular, you should seek appropriate medical guidance before fasting if you:
Do not use Burn as a substitute for professional medical care or delay seeking medical advice because of information presented within the app.
If you believe you may be experiencing a medical emergency, contact the appropriate emergency services immediately.
Burn may display fasting stages, metabolic information, estimated milestones, or other information based on the duration of a fast.
These features are estimates intended to help users understand the general physiological processes associated with fasting.
Individual responses vary, and Burn cannot determine precisely when a specific biological or metabolic process begins or ends within your body.
The display of a particular fasting stage does not guarantee that a particular physiological state, such as ketosis or another metabolic process, has been reached.
You are responsible for determining whether Burn is appropriate for you.
If you are not legally able to agree to these Terms in your jurisdiction, you may use Burn only with the involvement and permission of a parent or legal guardian where permitted by law.
You are responsible for the decisions you make based on information provided through Burn and for using the app in a safe and appropriate manner.
Subject to these Terms, WraithBit, Inc. grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use Burn for your own personal, non-commercial purposes.
This licence does not transfer ownership of Burn or any of its content to you.
Your use of Burn on Apple devices is also subject to the applicable App Store usage rules and Apple terms.
Certain Burn features may require a paid Burn Pro subscription.
The features included with Burn Pro may develop or change over time as Burn is updated.
Before completing a purchase, the App Store purchase screen will display the applicable:
Prices may vary by country, currency, App Store territory, tax treatment, and promotional offer.
Burn may offer free trials, introductory pricing, promotional subscriptions, or other offers from time to time.
Eligibility for these offers may be determined by Apple and may depend on your previous subscription or purchase history.
Where a free or discounted trial automatically converts into a paid subscription, the price and subscription period will be shown before you confirm the purchase.
Unless you cancel before the end of the applicable trial period in accordance with Apple's requirements, your subscription may automatically convert into a paid subscription.
Promotional offers may be changed, withdrawn, or restricted where permitted by law.
Burn Pro may be offered as an auto-renewable subscription.
Unless cancelled, your subscription will automatically renew for the applicable subscription period and your Apple Account will be charged the price shown for the renewal.
You can view and manage your subscription through your Apple Account subscription settings.
If you do not want a free or discounted trial to renew into a paid subscription, Apple recommends cancelling it at least 24 hours before the trial ends.
Cancelling a subscription stops future renewal. Unless otherwise determined by Apple or required by applicable law, you will normally continue to have access to the subscription until the end of the period you have already paid for.
Subscriptions purchased through the App Store must be managed through Apple.
You can generally manage or cancel a subscription by opening:
Settings > Apple Account > Subscriptions > Burn
Deleting Burn from your device does not automatically cancel an active subscription.
We cannot cancel an App Store subscription directly on your behalf because subscription billing is managed by Apple.
Payments for Burn Pro and other in-app purchases made through the App Store are processed by Apple.
Your payment is therefore also subject to Apple's applicable payment, billing, and App Store terms.
Refund requests for purchases processed by Apple are generally handled through Apple and are subject to Apple's refund policies and applicable consumer law.
Nothing in these Terms limits any refund or other consumer right that cannot legally be excluded.
Where supported, Burn may allow you to restore previous eligible purchases or subscription access associated with your Apple Account.
Purchase restoration depends on the purchase information provided through Apple and the continued availability of the relevant product.
You agree not to misuse Burn, the Burn website, or related services.
You must not:
We may restrict access to Burn where we reasonably believe these Terms have been materially violated.
Burn, including its software, design, interface, branding, graphics, illustrations, text, features, functionality, and other original content, is owned by or licensed to WraithBit, Inc. and is protected by applicable intellectual property laws.
The Burn name, logo, branding, and associated marks may not be used without our permission except where permitted by law.
Nothing in these Terms gives you ownership of Burn or any of our intellectual property.
If you voluntarily send us suggestions, ideas, feature requests, or other feedback about Burn, you permit us to use that feedback to develop, improve, and operate Burn without an obligation to compensate you.
This does not give us ownership of personal information or other material that you did not intend to submit as product feedback.
Burn may interact with services or technologies provided by third parties, including Apple services and other technical providers.
The availability and operation of those services may be governed by separate terms between you and the relevant provider.
We are not responsible for third-party services that we do not control.
Burn may provide functionality that interacts with Apple Health or HealthKit where you choose to enable it.
Your use of Apple Health is also subject to Apple's applicable terms and policies.
Information obtained through health and fitness integrations should not be treated as medical advice or as a substitute for professional healthcare.
We aim to keep Burn available and functioning reliably, but we do not guarantee uninterrupted or error-free access.
Burn may occasionally be unavailable because of:
We may modify, update, replace, discontinue, or remove features where reasonably necessary as Burn develops.
Where a change materially affects an active paid subscription, we will act in accordance with applicable law and App Store requirements.
Burn may require an appropriate Apple device, operating system version, internet connection, or access to certain Apple technologies.
We cannot guarantee continued compatibility with every device or operating system version indefinitely.
Updates may be released to improve functionality, introduce features, fix bugs, maintain compatibility, or address security issues.
You are responsible for keeping your device and Burn reasonably up to date.
Your use of Burn may involve information you enter into the app or information processed through connected services.
How information is handled is explained in our Privacy Policy, available on burnfasting.com.
The Privacy Policy forms part of the overall terms governing your use of Burn but does not reduce any rights available to you under applicable law.
To the fullest extent permitted by applicable law, Burn and its content are provided on an "as available" basis.
While we aim to provide a high-quality and reliable product, we do not guarantee that:
Results from fasting, nutrition, exercise, and other health-related behaviors vary significantly between individuals.
Nothing displayed by Burn should be interpreted as a guarantee of a particular result.
To the fullest extent permitted by applicable law, WraithBit, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Burn.
This includes, where legally permitted, loss of profits, revenue, data, opportunity, or other intangible loss.
To the fullest extent permitted by applicable law, our total liability arising from or relating to Burn or these Terms will not exceed the greater of:
These limitations do not apply where liability cannot legally be limited or excluded.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot legally be excluded, or any other liability that applicable law does not permit us to exclude.
These Terms do not remove or restrict statutory consumer rights that cannot legally be waived.
If you live in the United Kingdom, European Economic Area, or another jurisdiction that provides mandatory consumer protections, you retain those protections.
Where a provision of these Terms conflicts with a mandatory consumer right that applies to you, the mandatory right will take precedence to the extent of that conflict.
You may stop using Burn at any time.
We may suspend, restrict, or terminate access to Burn where reasonably necessary because of:
Termination of access to Burn does not automatically create a right to a refund except where required by applicable law or Apple's applicable policies.
Sections of these Terms that by their nature should continue after termination will remain in effect.
If you download Burn through Apple's App Store, you acknowledge that:
Your use of Burn may also be subject to Apple's Standard Licensed Application End User License Agreement and Apple Media Services Terms and Conditions where applicable.
These Terms and any dispute relating to them are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
However, if you are a consumer living in a jurisdiction with mandatory local consumer protections, this governing-law provision does not remove protections that apply to you under the laws of your country or region.
We encourage you to contact us first if you have a concern so that we have an opportunity to resolve it.
Subject to any mandatory rights you have under applicable consumer law, disputes relating to these Terms or Burn will be subject to the jurisdiction of the competent courts applicable under the governing law described above.
Nothing in this section prevents you from bringing a claim in another jurisdiction where applicable consumer law gives you a mandatory right to do so.
We may update these Terms as Burn develops, our business changes, or legal and regulatory requirements evolve.
When we update them, we will revise the "Last updated" date at the top of this page.
If a change materially affects your rights or your use of a paid service, we will provide additional notice where reasonably required.
Your continued use of Burn after updated Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be applied to the greatest extent legally possible and the remaining provisions will continue in effect.
These Terms, together with our Privacy Policy and any additional terms presented when you purchase or use a particular Burn feature, form the agreement between you and WraithBit, Inc. regarding your use of Burn.
They do not replace any separate terms that apply between you and Apple regarding your Apple Account, App Store purchases, or Apple services.
